Terms and conditions

The following terms and conditions shall apply when booking a tour with TRVL 360.

Payments and Tour Cancellation

A pre-payment of at least 30% is required to reserve a spot in a tour. The 30% is calculated from the full price of the tour as posted on this web page.

Remaining part of the payment is required not later than 30 days prior to the tour start date. The remaining part of payment is calculated as full price of tour adjusted for all applicable discounts minus the value of pre-payment.

The tour must be paid in full when booking less than 30 days from the start date of tour. Payments are accepted via major Credit Cards, Zelle, PayPal, WireTransfer.

The following terms and conditions shall apply when cancelling participation in a tour for ANY reason:

When cancelling more than 31 days before the start of tour a full refund shall be made
When cancelling within 15-30 days before the start of tour the customer has the following choices:

Transfer 75% of the payment to another tour within 1 calendar year of the start date of the cancelled tour
Cancel participation with forfeiture of the payment up to 50% of the full price of tour.

When cancelling less than 15 days before the start of tour the customer has the following choices:

Transfer 25% of the paid amount (at this point – full price of tour adjusted for discounts) to another tour within 1 calendar year of the start date of the cancelled tour
Cancel participation with 100% forfeiture of the payment. Nothing shall be refunded
If a customer is able to find a replacing participant, he/she will be entitled to a 100% refund or transfer to another tour, no matter how many days remain to start of tour.

If a trip is cancelled by TRVL 360 for ANY reason except Force Majeure, each participant will be entitled to a 100% refund or transfer to another tour. Additional costs, such as flights, insurance, visas and all and any other costs associated by the customer with the tour, including any sort of moral damages, shall not be considered relevant or compensated.

If a trip is cancelled by TRVL 360 due to Force Majeure, customers shall be entitled to a transfer to another tour of up to 75% of paid value.

Changes to trip itinerary or accommodation made by TRVL 360 for ANY reason shall NOT be considered as reason to request a refund.

Customers are encouraged to purchase travel insurance through a third-party in order to be protected from cancellation costs either by the customer or TRVL 360.

By continuing my reservation and participating in the Trip I agree that I have carefully read the above conditions and consider them a binding legal agreement.

Release of Liability, Acknowledgement of Risk and Indemnification Agreement

Understanding of associated risks

I have chosen to participate in the activities (hereafter referred to as “Trips”) organized by TRVL 360, Inc., including its owners, employees, officers, directors, independent contractors, suppliers, agents, guides, volunteers, subsidiaries, affiliates, successors, agents, and assignees (hereafter referred to as TRVL 360). These activities may include (but not limited to) the following: participation in an adventure travel tour; canyoneering; caving; cycling; horse riding and other equine activities; hot air balloon rides; paragliding; road and mountain biking; rock, snow, and ice climbing; skiing and snowboarding; ski mountaineering; rope usage; rappelling; zip lining; scuba diving; ATV and snowmobile riding and driving; helicopter and small aircraft activities; white water rafting; kayaking; travel in boats; sailing; hiking; backpacking; mountaineering; surfing; camping; use of remote backcountry huts; visiting the wilderness; travel in public and private transportation (including to and from tour areas) (hereinafter “activities”).

I recognize these activities are inherently hazardous and involve numerous risks, which include, by way of example only, falling, drowning, rockfalls, avalanches, cliffs and the risk of falling from cliffs if I approach the edge, hypothermia, frostbite, altitude sickness, equipment failures, traffic accidents, attack by insects or animals, weather including heat, cold, sun, water and wind, fatigue, chill, overheating, and/or dizziness, which may diminish my own reaction time and increase the risk of accident. I recognize that in relation to the Trip (before, during or after) I may be seriously hurt or disabled or may die, and that my property may also be damaged. I also recognize that risk of injury, damage or death may be caused or enhanced by mistakes or negligence on the part of either TRVL 360 or other trip participants. I may be injured by participating in physical excursions for which I am not prepared. I further recognize that the remoteness of the activities may preclude prompt medical care or rescue, or such services may be expensive; and that TRVL 360 assumes no responsibility for providing medical care during the Trip, and I will have to pay for any medical care and/or evacuation that I incur. I agree that TRVL 360 is not liable for the negligence or lack of adequate training of any agents, owners, contractors or employees of TRVL 360 who seek to assist with medical or other help either before or after injuries have occurred. I understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death.

Acknowledgement of risks

I hereby freely assume the above-mentioned risks and any harm, injury, loss or damage that may occur to me, any minors traveling with me, or my property as a result of my participation in the Trip, including any risks caused by the negligence of TRVL 360, and other trip participants.

Waiver and release of liability

I, on behalf of myself and any minors traveling with me, hereby WAIVE AND RELEASE ALL LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS against TRVL 360, its owners, employees, officers, shareholders, directors, independent contractors, suppliers, agents, guides, volunteers, subsidiaries, affiliates, successors, agents, and assignees ("Released Parties"), where such LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS arise in any way from any injury, death, loss or harm (whether foreseen or unforeseen) that occur to me or to any other person or to any property during the Trip or are in any way related to the Trip. This release includes, but is not limited to, claims for the negligence of the Released Parties and claims for strict liability for abnormally dangerous activities.

I, on behalf of myself and any minor traveling with me, agree to release and discharge TRVL 360; my fellow participants in TRVL 360 activities, from all actions, claims, or demands, both for myself and any minors traveling with me and for my and/or their heirs, dependents, and/or personal representative, for injury, death, or property damage occurring in the course of or in connection to my or the minor’s participation in the Trip.

I, on behalf of myself and any minor traveling with me, also agree NOT TO SUE or make a claim against the Released Parties or my fellow participants in TRVL 360 activities for death, injuries, loss, harm or property damage that occurs as a result, during or in connection with this Trip.

I, on behalf of myself and any minor traveling with me agree that this release shall be legally binding upon me personally, all members of my family and all minors traveling with me, my and their heirs, successors, assigns, and legal representatives, it being my intention fully to assume all the risks associated with this trip and to release the Released Parties from any and all liabilities to the maximum extent permitted by law.

Indemnification, hold harmless and defend

I hereby INDEMNIFY, WARRANT, HOLD HARMLESS AND DEFEND the Released Parties (defined above) against any and all LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS that arise from my acts or my failure to act (including my own negligence) during or relating to the Trips. In accordance with this promise, I will reimburse the Released Parties for any damages, reasonable settlements and defense costs, including attorney's fees, that they incur because of any such claims made against them. I agree that in the event of my death or disability, the terms of this agreement, including the indemnification obligation in this Section, will be binding on my estate, and my personal representative, executor, administrator or guardian will be obligated to respect and enforce them. I agree that this Indemnification shall be legally binding upon me personally, all members of my family and all minors traveling with me, my and their heirs, successors, assigns, and legal representatives, it being my intention fully to assume all the risks associated with this trip and to release the Released Parties from any and all liabilities to the maximum extent permitted by law.

Health and Safety Acknowledgement

I am aware that the physical exertion required to participate in the Activities can activate or aggravate pre-existing injuries, physical and mental conditions, or congenital defects. I acknowledge that I should seek medical advice if I know or suspect that my physical or mental condition may be incompatible with the Activities. I acknowledge that I am required to wear approved safety equipment while participating in certain Activities, as well as strictly follow the instructions of TRVL 360.

I agree to inform TRVL 360 about physical and mental conditions or health issues that I have and that may potentially affect my safety during the Trips, as well as safety of TRVL 360 and other trips’ participants. The fact that I informed TRVL 360 does not in any way relieve me from assuming all the risks and liabilities related to my participation in any Trip.

I also understand and agree that it is my responsibility to carefully read the description, itinerary and conditions of the trip (available on TRVL 360 web page www.TRVL360.com) before I decide to participate, and select the trips that are appropriate for me.

Alcohol, drugs, and other substances

I recognize that if I use, consume, or am under the influence of alcohol or drugs prior to or while engaging in the Activities, I assume and accept all risks, dangers and hazards that may result from this, including the possibility of personal injury, death, property damage, even in the event of negligence or fault by TRVL 360 or third parties. I also recognize that consumption of abovementioned substances may be considered a criminal offence by a government, territory or legal body. I, therefore, indemnify TRVL 360 from any and all liability for any damage to property or personal injury to any third party or legal proceedings, resulting from my participation in the Activities, while, during, or after consumption of drugs or alcohol.

Pets

In accordance with the National Parks rules, hotel and other accommodation rules, as well as out of considerations of comfort of fellow travelers, pets are not allowed on TRVL 360 tours and activities.

Commitment to rules

I commit to follow the rules of the areas and legal bodies I visit during the trip including, but not limited to, National, State, County Parks, Forests, Shores, Reserves. Such rules include, but are not limited to, following the leave no trace and fire safety principles.

As drones and other unmanned aerial vehicles are prohibited from most of the National Parks, they may not be used on TRVL 360 trips.

My consent to medical treatment

I consent to any hospital or medical care that may be necessary as a result of my participation in TRVL 360 activities. I understand and agree that I am solely responsible for all charges for such medical treatment, including evacuation and/or rescue costs. I understand that TRVL 360 does not carry or maintain health, medical, or disability insurance coverage for any participant. Each participant is expected and encouraged to obtain his or her own travel insurance as well as medical or health insurance coverage, and to check with his or her own health insurance provider about coverage while traveling abroad.

Severability and other terms

I agree that the purpose of this agreement is that it shall be an enforceable release of liability and indemnity as broad and inclusive as is permitted by California law. I agree that if any portion or provision of this agreement is found to be invalid or unenforceable, then the remainder will continue in full force and effect. I also agree that any invalid provision will be modified or partially enforced to the maximum extent permitted by law to carry out the purpose of the agreement.

Any lawsuit relating to TRVL 360 activities or this release shall only be filed in Broward county, FL.

This Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives, in the event of my death or incapacity.

This Agreement shall remain in force for my participation in all Trips organized by TRVL 360.

FOR PARTICIPANTS OF MINORITY AGE: I hereby certify that I, parent/guardian with legal responsibility for this participant of minority age. I accept and agree to the full contents of this agreement. I understand that I am responsible for, and I accept the responsibility for the supervision throughout the duration of the Trip of any minor traveling in my care. I also agree to RELEASE, HOLD HARMLESS, INDEMNIFY AND DEFEND the Released Parties (defined above) from all liabilities and claims that arise in any way from any injury, death, loss or harm that occurs to my minor child during the Trip or in any way related to the Trip. This includes any claim of the minor and any claim arising from the negligence of the Released Parties.

Confirmation

I have fully read and understand the contents of this agreement before signing it. I am aware that by signing this Agreement I am waiving certain legal rights which I may have against TRVL 360. By entering into this Agreement, I am not relying on any oral or written representation or statements made by TRVL 360 other than what is set forth in this Agreement.

I recognize that my checking the box when I book over website www.TRVL360.com is considered equal to signing this agreement and has the same binding power.

I recognize that by continuing my reservation and participating in the Trip I agree that I have carefully read this agreement, understand its content and recognize it is a binding legal agreement.

PARENT OR GUARDIAN OF A MINOR: I, as a parent or guardian of a minor participant of a Trip, hereby give my permission for my child or ward to participate in the trip and further agree, individually and on behalf of my child or ward, to the terms above.
